Megjegyzések:Civil law regulates the relations between legal entities regarding the tangible and intangible property. It is based on the principles of not interfering with inequality and independence of participants, inviolability of property, freedom to contract, non-interference in private matters, implementation of civil rights and obligations without restriction, and restoration and judicial protection of the violated rights. Either party of a contract should not deteriorate the rights and interests of the other party and should not have any privilege. The parties should respect their and others` rights and conclude a contract in conformity with the interests of each other. Civil law may be defined as having the purpose to protect the rights and interests of the loan contract parties or both borrower and creditor and to prevent unlawful infringement of their rights and interest. Therefore, it is compulsory to ensure equality of the parties in civil legal relations and to have regulations to protect their rights and interests. This time, I focused on the civil regulations to protect the rights of a creditor, which is one of the parties to a loan contract raised the issues about ensuring the creditor`s interest and preventing risks and tried to answer the question: "Is there any regulation in Mongolia on the fraudulent transfer of property to others?".
