Megjegyzések:The doctrine of clausula rebus sic stantibus is one of the most interesting principles is the European civil law. The principle used the problem of unexpected changes by the contracts. Irish contract law is based on the Common law tradition. After 1922 Australia, New Zeland and Canada have also been followed by Irish Courts. But the Irish law not legislated the frustration (which is the new form of the clausula), the problem was resolved by with the 1943 Law Reform Act, which was current in England too. Next to the legislation the precendents formed the legislation for the frustration. The publication analyzes the reasons to which referred the identifying the frustration, for example war, inflation, illness, death and any other unexpected circumstances.In my study I present the survival of the principal "clausula rebus sic stantibus" and the "frustration" in Ireland and in England in the XXth and XXIst century. I show some interesting and important cases in common law, which defined the application circle of the frustration. The study contains the important laws for the frustration in England and Ireland too.
