Megjegyzések:Most of the countries in the world are abolishing death penalty under the basis of the protection ofhuman rights that has been internationally recognized as universal rights. As a matter of fact, China andIndonesia have different practice imposing death penalty for certain crimes. By using the method ofnormative legal research, this study examines two legal issues, such as: how far the protection of humanrights in China and Indonesia; and how the international human rights law influences the death penaltypolicy both in China and Indonesia. The study then comes into two conclusions that: first, there aredifferences in the implementation of human rights both in China and Indonesia particularly in applyingthe death penalty both countries have certain limitations in its implementation. Second, the ratificationof the International Covenant on Civil and Political Rights is the basic reason of how far of the two countries impose the death penalty and how much effort of the two countries in harmonizing domestic laws with other related international human rights law.
