Cím:Judicial Populism and the Weberian Judge? The Strength of Judicial Resistance Against Governmental Influence in Hungary / Bencze, Mátyás
Dátum:2021
ISSN:2071-8322
Megjegyzések:The Hungarian judiciary has reacted to the political change of recent years in a twofold way. Some judges have resisted political pressure and decided cases according to the law and their conscience, while others, showing the signs of judicial populism, have deferred to the interests of the government. The paper explains the relationship between this twofold behavior and the bureaucratic tradition of the Hungarian justice system. The conclusion is that the bureaucratic model of organization has certain features that can make judges more resistant to political pressure, while other elements of the model can lead to judicial deference. Nonetheless, these latter elements are not necessary components of the 'Weberian' justice system. ? 2021 The Author(s). Published by Cambridge University Press on behalf of the German Law Journal.

Cím:Smart Taxation in the Hungarian Tax System / Bordás Péter
Dátum:2021
ISSN:1224-9173 2247-8361
Megjegyzések:Affected by social and economic processes, tax systems seem to be in a transition all over the world. This transition is not only necessary for ensuring state or public revenues but also for handling certain situations, such as the expansion and escalation of digitalization or the one caused by the covid19 pandemic, which emerged and spread last year. The technologies and business models applied in a variety of economic activities continue to develop, and we get to face new technological advancements, methods of tax evasion and social problems, which all need to be addressed and solved. Tax revenues are primarily used by the state to finance public goods and services. Consequently, it is of essential importance how the state plans and designs their structure and channels of collection. Well-designed taxes support economic growth and investments, they encourage and foster job creation, increase economic competitiveness and improve social fairness and justice. This study aims to present the fundamental notions and concepts of smart taxes and taxation through the example of the smart solutions recently introduced in Hungarian tax administration. The reason for this is that ensuring state revenues, stabilizing the economy and the situation of the workers and employees and reducing the administrative burden related to taxation are important priorities even for the Hungarian legislators, which is the reason why quite a few smart solutions have been established here in the past couple of years.

Cím:Hungary as a norm entrepreneur in migration policy / Czina Veronika
Dátum:2021
ISSN:2416-089X
Megjegyzések:This paper analyses Hungary as a small state within the EU and the policy it applied during the refugee crisis of 2015/2016 that changed the landscape both on the European and Hungarian level. During the crisis, Hungary acted as a small, interest-maximizing Member State constrained by domestic political interests, and it not only refused to participate in common European policy proposals aimed at solving the crisis, but it also engaged in unilateral actions perceived as solutions, such as erecting a border wall on the southern border of Hungary. This paper examines how Hungary acted during the refugee crisis with the help of small state theories. Presenting the events, legislative changes and discourses surrounding migration policy in the past years will show that Hungary managed to take advantage of the refugee crisis by acting as a norm-entrepreneur by articulating its own views and convictions about the right way to solve the crisis, and also about the future of the EU as a whole. Many EU Member States joined Hungary in its migration strategy, so it became the leading country of the anti-immigration block in Europe.

Cím:Game Theory and Criminal Proceedings / Elek Balázs
Dátum:2021
Megjegyzések:The expression "game theory" is essentially a scientific metaphor where two or more individuals with opposing or mixed motivations take actions, employing strategies that are both interdependent and also build upon each other. The game-theory method makes possible the study on how individuals on opposing sides make decisions in a given situation. It also applies to those life situations where a decision made by an individual has no power over other decisions that affect him. The decision maker can be an individual, a group, or an organization. Game theory can analyze situations where participants must take decisions that pose risks. In these situations, at least two players try to maximize their own socalled "utility function. Game theory can be used to model criminal proceedings, as each decision carries a risk with respect to the end result. If the accused and their attorneys adequately apply game theory to their strategies, then they will achieve the result that is most optimal for themselves. Game theory also makes it easier to understand the actions of the participants in criminal proceedings and therefore to understand certain testimony, especially betrayal; game theory helps us properly assess the creditworthiness of incriminating statements that one defendant makes about another.
